The following terms and conditions are considered accepted once an
order has been placed by the customer.
Delivery and Delay in Delivery
The confirmed
delivery time is as accurate as possible. However, delivery schedules can
be delayed due to unforeseen circumstances or due to delays on behalf of
sub-contractors. We reserve the right to extend the delivery schedule on
account of the above without having to offer compensation to the customer.
Partial deliveries are permitted. The delivery schedule starts on the day
the order is placed.
Despatch
Supplies of each kind
take place in the inland only against cash on delivery or
prepayment. Abroad only against prepayment. With our component systems the
dispatch takes place only against prepayment.
Forwarding expenses compute themselves according to
the current forwarding expenses tables of the logistics enterprises
assigned by us (UPS or the German post office AG). The
packing costs are charged for depending upon expenditure to first cost
! With
articles those than 1,2m are longer, take place an impact for bulky goods
costs at a value of 20, -€ !

Abroad
we dispatch only against prepayment. Postage and packing costs are charged
for to first cost. It
applies excluding German right and German
jurisdiction.
Transfer of Risk
Once the goods have
been handed over to the designated carrier, the risk is for the buyer's
account. In the case of damage we can deal with the claim for the
customer; in this case a damage claim is to be issued immediately after
receipt of the cargo together with a copy of the forwarder's cargo receipt
showing the relevant comment about damage.
Prices
All prices are inclusive in
euro, excluding packing and the valid legal value added tax. In each
case on the day of the order the valid prices are computed. Price
and technical changes remain reserving.
Minimum Order Value
The minimum order
value is € 15.00 Any orders to a lesser value will be subject to a
surcharge of €
5.00
Reservation of Proprietary Rights
All goods remain the
property of the seller until all demands (including any that may
arise in the future) are fulfilled.
Guarantee
If the goods
delivered are found to be faulty we have the right to choose the method of
correction i.e. repair, a replacement delivery, reimbursement or
alternative offer. Customer claims for obvious faults must be lodged with
us within 8 days of receipt of the goods. We cannot be made responsible
for any claims or damages resulting from the incorrect use of products
from our range since we are unable to check that goods are used in the
correct manner.
Right of Cancellation
The customer has the right to cancel an
order within 2 weeks. This 2 week cancellation period begins
on the day the goods are received. If the goods have been
delivered in partial deliveries, the cancellation period begins on receipt of the first
partial delivery. It is not necessary to comment cancellation if the goods are
returned. It is sufficient to arrange the timely return of the goods in
question. However, in this case the purchaser is obliged to return the
unwanted goods to the seller. Any payments that have already been effected will immediately
be returned to the purchaser. Any goods that have been made especially for
a particular customer i.e. our kits are exempt from this regulation.
Furthermore returned goods will only be accepted if they are packed in the
original packing material and in perfect condition.
Protection of the Individual Against the Infringement of his/her
Rights Through Storage of Computerized Data
The person placing
the order with us agrees to their personal data - relevant to the order
and order processing - being filed on computer within the framework of the
a.m. protection rights.
Court of Jurisdiction
German law applies. The court of jurisdiction is the same for both
parties - as far as applicable - and is the county or district court at
the place of business for "Modellbau

Place Where the Contract is to be
Fulfilled
According to these general terms and conditions of sale the place
where any contract is fulfilled is the place of business for "Modellbau
Schlundt". If any one of the conditions listed above are or become null
and void the validity of the other conditions remains
unchanged.
